If you have fraudulent capture of certain branches of government (RICO), such that criminal enterprises that are provably anti- American "direct the law", to the harm of the Constitution and the public -- wouldn't it depend on HOW you argue fraudulent capture of the U.S.Constitution via presidential/AA discretion?

I’m in Australia and have focussed on the trashing of voluntary informed consent here, but starting to look into the impact of the Prep Act in the US because this is having ramifications around the world.
As I understand it, the Prep Act purportedly provides "immunity from liability (except for willful misconduct) for claims:...to entities and individuals involved in the development, manufacture, testing, distribution, administration, and use of such countermeasures".
Isn't it willful misconduct if a ‘countermeasure administrator’ 'administers a countermeasure' to an individual who has not given authentic voluntary informed consent for the 'countermeasure' e.g. a COVID-19 vaccination?
This can occur in the case of an individual who has been mandated to have COVID-19 vaccination to maintain their livelihood and participate in society.
Isn’t it willful misconduct if a ’countermeasure administrator’ injects someone they know is under duress to submit to the ‘countermeasure', i.e. there has not been valid consent?
